Article 1: Copyright
All photos remain the exclusive property of the photographer at all times. Only a limited edition (maximum 10 copies) of prints are sold. It is strictly forbidden to make copies in any form whatsoever, including digital reproductions, or to grant licenses without the permission of the photographer, without written permission.
No image from the collections offered may be used for publication purposes without the express written permission of the photographer.
Article 2: General stipulations
This webshop enables customers to purchase photographic material online. These general terms and conditions apply to all orders placed via the webshop. Any deviating conditions of the customer are only valid if they have been explicitly approved in writing by the photographer.
Article 3: Price
All prices stated are in euros and include VAT, unless otherwise stated. Any additional costs, such as delivery or administrative costs, are stated separately.
Article 4: Offer
Although the webshop has been put together with the greatest care, errors or omissions in the offer may still occur. Obvious mistakes or errors are not binding. All images are printed exclusively to order, there is no stock available.
Each image has a limited edition of maximum 10 copies, regardless of the chosen dimensions equal to or larger than 40 x 30 cm for 4:3 ratio, equal to or greater than 45 x 30 cm for ratio 3:2, and equal to or greater than 45 x 45 cm for 1:1 ratio.
The photographs shown with the products are for illustrative purposes only and may contain elements that are not included in the purchase price.
The photographer also reserves the right to print three copies of each image for personal use. This print run restriction does not apply to publications in books, magazines, newspapers, postcards, smaller print formats or for commercial and advertising applications.
Article 5: Payment
Payment must be made immediately upon ordering.
Payment can be made by bank transfer, bank card or credit card. The photographer reserves the right to refuse orders when there are serious shortcomings in previous transactions of the customer.
Article 6: Delivery and execution of the agreement
The stated delivery times are indicative and the customer cannot derive any rights from them.
Any visible damage or quality defects must be reported by the customer immediately, no later than 8 days after the product has been shipped. The risk of loss or damage passes to the customer at the time the goods are received.
Article 7: Retention of title
The delivered goods remain the property of the photographer until full payment has been made.
Article 8: Right of withdrawal
This stipulation applies exclusively to consumers; persons who are not consumers have no right of withdrawal in any case.
Since the photos are printed to order and are therefore made to measure, the right of withdrawal is excluded in accordance with Article VI.53, 3° of the Code of Economic Law.
If services are provided, a proportionate amount is due that corresponds to the portion of the services already performed in relation to the full performance.
Article 9: Warranty
The guarantee is limited to the legal guarantee for consumers and/or companies. In order to make a claim under the guarantee, the customer must be able to provide proof of purchase. The guarantee is void if damage is caused by incorrect use, storage, negligence or modifications to the product.
Article 10: Sanctions for non-payment
In case of non-payment or late payment, the client is automatically, without notice of default, liable to pay interest on the outstanding amount of 12 percent per year. Unpaid items remain the property of the photographer.
Article 11: Privacy Policy
The photographer processes personal data in accordance with the General Data Protection Regulation (GDPR). The client has the right to view, change or delete his data at all times.
Article 12: Affectation of validity – non-waiver
If any provision of these terms and conditions is declared invalid or void, the remaining provisions will remain in full force. Failure by the photographer to enforce a right does not mean that this right is forfeited. In the event of invalidity of a provision, an attempt will be made to interpret it in such a way that the provision is declared valid.
Article 13: Changes to conditions
The photographer reserves the right to change these conditions. The version that applies is the one that applies at the time of order.
Article 14: Applicable law and competent court
These terms and conditions are governed by Belgian law. In the event of disputes, only the court of the photographer's place of business is competent. The photographer can also turn to the Online Dispute Resolution (ODR) platform of the European Commission. This is a translation of the Dutch text. In case of dispute, the Dutch text applies.
